Welcome to ShapWork. By accessing or using our website and services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our services.

2. Description of Service

ShapWork is a freelance marketplace that connects businesses and individuals ("Clients") with independent professionals ("Freelancers") for various services. We provide the platform for these connections but are not a party to the contracts formed between Clients and Freelancers.

3. User Accounts

To use certain features of the site, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. User Conduct

You agree not to:

• Use the site for any illegal purpose or in violation of any local, state, national, or international law.
• Harass, threaten, or defraud other users.
• Post content that is infringing, libelous, defamatory, obscene, pornographic, abusive, or offensive.
• Attempt to circumvent the ShapWork payment system.

5. Payments and Fees

Clients pay ShapWork for services rendered by Freelancers. ShapWork holds funds in escrow and releases them to Freelancers upon satisfactory completion of work, subject to our service fees.

All payments must be made through the ShapWork platform. Attempting to pay outside the platform is a violation of these terms and may result in account suspension.

6. Intellectual Property

Unless otherwise agreed in writing between the Client and Freelancer, upon full payment, the Client acquires all rights, title, and interest in and to the delivered work. Freelancers retain the right to use the work for their portfolio unless a non-disclosure agreement is in place.

7. Disclaimers and Limitation of Liability

ShapWork provides the site "as is" and "as available." We do not guarantee that the site will be uninterrupted or error-free. We are not liable for any damages arising from your use of the site or any services provided by Freelancers.

8. Termination

We may terminate or suspend your account and bar access to the service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

9. Changes to Terms

We reserve the right to modify these terms at any time. We will provide notice of significant changes by posting the new terms on the site.
